Virginia court rules adhere to the principle of considering “the best interest of the child” in all matters related to a child’s custodial parent(s). That is generally defined as what arrangement gives the instant child the best chance to thrive and prosper. In every case, the court “shall insofar as practical, and consistent with the ends of justice, preserve the dignity and resources of family members.”
Often, mediation of a child custody dispute can produce favorable results. Dickerson and Smith encourages all clients to consider this option as it can be less costly and less confrontational. However, in each case, the court will ultimately issue an order establishing a schedule of visitation. Virginia courts take into consideration many different factors in determining appropriate visitation schedules and under what constraints that visitation will occur. In cases that must be decided by the court, the financial, psychological, and overall familial status of all parties will be evaluated and assessed. The court will determine many issues, such as: Will the visits be overnight or only during the day? Will the schedule be flexible enough to allow room for special events? If so, how much notice must be given by the other parent? Will there be supervision during the visits? All these questions loom large in any such case, and require those with the experience and knowledge needed to fight for the most fair and equitable arrangements for your children.
