Reviewing Virginia’s laws about DUI

Virginia drivers should understand the state’s laws about driving under the influence. DUI offenses carry serious legal consequences and can significantly impact your life.

Understanding the types of DUI charges and possible penalties can help you or a loved one navigate the legal system after a traffic arrest.

Blood alcohol limits

The legal limit for blood alcohol concentration is 0.08%. The state considers you legally intoxicated with BAC above this level. Drivers who are younger than 21 can receive a DUI for any amount of detectable alcohol in the blood.

Implied consent

By getting a state driver’s license, you automatically consent to chemical testing if lawfully arrested for DUI. Under this implied consent, refusing a breath or blood test can lead to immediate consequences. You could receive license suspension and fines.

Penalties for DUI

The state imposes strict penalties for DUI offenses. The severity of these penalties increases with the number of offenses. Legal consequences may include fines, license suspension, mandatory alcohol education programs and jail time. Repeat DUI offenses in result in escalating penalties.

The state imposes enhanced penalties for drivers with a BAC significantly higher than the legal limit. A BAC of 0.15% or higher can result in longer license suspension, mandatory ignition interlock device installation and participation in the Virginia Alcohol Safety Action Program. An IID prevents the engine from starting until you pass a breath test.
